Arvex Terms of Service
1. Introduction
Welcome to Arvex.io, a captions generation tool that allows users to create engaging captions for their videos. These Terms of Service ("Terms") govern your access to and use of our services. By signing up and purchasing a subscription, you ("the User") agree to abide by these Terms. These Terms constitute a legally binding agreement between you and Arvex.io ("Arvex", "we", "us", or "our").
2. Registration and Account
To use our services, you must register for an account. You agree to provide accurate and complete information during the registration process and to update such information as needed. You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree not to disclose your password to any third party and to immediately notify us of any unauthorized use of your account.
3. Subscription and Payment
Our services are available on a subscription basis. You agree to pay all applicable fees related to your use of our services. All fees are non-refundable except as expressly provided in these Terms. We reserve the right to change our prices at any time. You authorize us to charge your payment method for these amounts and any additional amounts (including any taxes and late fees, as applicable) that may be accrued by or in connection with your account.
4. Privacy Policy
We respect your privacy and are committed to protecting your personal information. We collect and store your name and email address on our partner's private servers (Supabase), which are highly secure. We use this information solely for the purpose of providing our services to you and improving your user experience. We do not share your personal information with third parties without your explicit consent, except as required by law or to protect our rights. We implement a variety of security measures to maintain the safety of your personal information when you enter, submit, or access your personal information.
5. Content Ownership
All content created using our tool remains the property of the user. Arvex does not claim ownership of any user-generated content. By using our tool, you grant us a non-exclusive, royalty-free license to use, reproduce, distribute, and display your content solely for the purpose of providing our services to you. You represent and warrant that: (i) you own the content posted by you on or through the service or otherwise have the right to grant the rights and licenses set forth in these Terms; (ii) the posting and use of your content on or through the service does not violate, misappropriate or infringe on the rights of any third party, including, without limitation, privacy rights, publicity rights, copyrights, trademark and/or other intellectual property rights; (iii) you agree to pay for all royalties, fees, and any other monies owed by reason of content you post on or through the service; and (iv) you have the legal right and capacity to enter into these Terms in your jurisdiction.
6. User Conduct
Users are expected to use our tool responsibly and legally. Any activities prohibited by law, including but not limited to the creation of illegal content, are strictly prohibited. Users are solely responsible for their conduct and any content they create using our tool. We reserve the right to investigate and take appropriate action against anyone who, in our sole discretion, violates these Terms, including without limitation, removing the offending content from our services, suspending or terminating the account of such violators, and reporting you to law enforcement authorities.
7. Dispute Resolution
In the event of a dispute, users are required to contact Arvex before initiating any legal proceedings. We will respond within 1-3 business days. Refunds will be issued only in cases where a registered user has purchased a subscription plan and the software is not functioning as promised.
8. Limitation of Liability
Arvex is not liable for any damages or losses incurred due to the malfunctioning of our software, except in cases where the software is not working as promised. This does not include situations where the user's internet connection or device is not compatible with our software.
9. Termination of Service
Arvex reserves the right to terminate a user's account if they use our software for illegal activities or any activities prohibited by law. Upon termination, all user data will be deleted from our servers.
10. Refund Policy
Please note that all sales are final and refunds are not typically provided. Exceptions may be made on a case-by-case basis, in accordance with our dispute resolution policy.
11. Changes to Terms
We reserve the right to modify these Terms at any time. If we make changes to these Terms, we will provide notice of such changes, such as by sending an email notification, providing notice through our services, or updating the "Last Updated" date at the end of these Terms.
